h) Processor: is a particular or legal person, public authority, agency or other body which processes personal data on behalf of the Controller.
j) Recipient: is a particular or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigative task shall not be considered as recipients.
i) Third Party: means a particular or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons authorized to process the personal data under the direct responsibility of the controller or the processor.
j) Consent: means any freely given indication of the data subject's wishes for the specific case in an informed and unambiguous manner, in the form of a statement or any other unambiguous affirmative act by which the data subject indicates that he or she consents to the processing of personal data relating to him or her.

Your Rights

• • Right to obtain a “restriction of processing your personal data”: As data subject, you have the right to obtain from us restriction of processing your personal data where one of the following conditions is met: (1) The accuracy of the personal data is contested by the data subject for a period enabling the controller to verify the accuracy of the personal data. (2) The processing is unlawful, the data subject objects to the erasure of the personal data and requests instead the restriction of the use of the personal data. (3) The controller no longer needs the personal data for the purposes of the processing, but the data subject needs it for the assertion, exercise or defense of legal claims. (4) The data subject has objected to the processing pursuant to GDPR Article 21 (1) and it is not yet clear whether the legitimate grounds of the controller override those of the data subject. If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of personal data stored by NGEN SYSTEMS S.R.L., he or she may, at any time, contact our data protection officer or another employee of the controller. The data protection officer of the controller will arrange the restriction of the processing.

NGEN SYSTEMS S.R.L. shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the assertion, exercise or defense of legal claims. Managing your communication preferences

If you would like to change your preferences regarding communications (including marketing communications), you can do so at any time in your NGEN account under "Communication Preferences". If you do not wish to receive email marketing communications from us, you can also unsubscribe by clicking on the link in the email you received. For technical reasons, the implementation may take a few days. For information on how to manage your cookies and similar technology preferences, see the next section “Use of Cookies”.

Storing Period

The controller processes and stores your data only as long as it is necessary for processing or to fulfil legal obligations. After that, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.

Personal data

If you use this website without e.g. registering or using the contact form, we collect technically necessary data that is automatically transmitted to our server, such as: IP address; Browser type (language and version of the browser software); Date and time of the visit including accessed pages; Content of the request; Access status/http status code; Operating system. This is necessary for technical reasons, as well as to ensure the security and stability of our website. The legal basis for the collection is Art. 6 GDPR.

Comment Function

The data subjects have the possibility to leave individual comments on individual blog contributions on a blog, which is on the website of the controller. The blogposts can usually be commented on by third parties. The users can comment on posts on our website. When you comment on a post, we collect and store the data you enter in the submission form (e.g. middle name, first name, address, contact details). Your data will not be passed on to third parties. If consent is given, the legal basis for the processing is Art. 6(1)(a) GDPR. The purpose of the data collection is the enforcement of our comment rules. Moreover, it is possible for a commentator to subscribe to the comments following his or her comment on a specific blog post. If a data subject opts for the option to subscribe to comments, the controller will send an automatic confirmation e-mail in order to verify in a double opt-in procedure that the owner of the specified e-mail address has indeed opted for this option. The option to subscribe to comments can be terminated at any time.

Contact Form

You can enter personal data using a contact form. If you use the contact form, we will collect and store the data you enter in the input screen (e.g. s middle name, first name, address, contact details). There will be no forwarding to any third party. The legal basis for the processing in case of consent is Art. 6(1)(a) GDPR. We use the data exclusively to process and answer your request.

Newsletter

On our website you have the option to subscribe to a newsletter. With this NGEN SYSTEMS S.R.L. informs its customers and business partners at regular intervals. If you subscribe to the newsletter, we collect and store the data you enter in the newsletter subscription form (e.g. middle name, first name, address, contact details). No data will be passed on to third parties. The personal data collected in the context of a registration for the newsletter are used exclusively for sending our newsletter. Subscription to the newsletter is only possible with your consent. The legal basis for the processing is Art. 6(1)(a) GDPR. At the time of newsletter registration, we use the double opt-in procedure. A confirmation e-mail will serve to verify whether the owner of the e-mail address, as the data subject, has authorized the receipt of the newsletter. When registering for the newsletter, we also store the IP address of the computer system used, the Internet service provider (ISP), as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of the e-mail address of a data subject at a later point in time and therefore serves the legal safeguarding of the controller. The consent to the storage of personal data that the data subject has given us for the newsletter mailing can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in each newsletter. Furthermore, it is also possible to unsubscribe from the newsletter mailing directly on the website of the controller at any time or to notify the controller of this in another way.

Newsletter tracking

The newsletters of NGEN SYSTEMS S.R.L. contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded in such e-mails that are sent in HTML format to enable log file recording and log file analysis. This enables a statistical evaluation of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, NGEN SYSTEMS S.R.L. may see if and when an e-mail was opened by the data subject. Personal data collected via the tracking pixels contained in the newsletters are stored and analyzed by the controller. Registration/Orders

Registered persons are free to modify the personal data provided during registration at any time or to have it completely deleted from the data stock of the controller. Your data will not be passed on to third parties, unless there is a legal obligation to pass it on or the passing on serves the purpose of criminal prosecution. If consent is given, the legal basis for the processing is Art. 6(1)(a) GDPR. If the purpose of your registration is to take steps prior to the closing of a contract, Art. 6(1)(b) GDPR is an additional legal basis. You may provide us with additional information by participating in community discussions, member chats, surveys, inquiries, dispute resolution, customer service calls, or if you contact us for any other reason regarding our Services.

Other Transfers

We transfer personal data to external parties only to comply with our contractual or legal obligations (e.g. Payment service providers, External operators of websites, applications, services and tools). We are required by law to transfer data to government bodies, e.g. tax authorities, supervisory authorities and law enforcement agencies. When transferring data to external entities in third countries, i.e. outside the EU and/or the EEA, we ensure that these entities treat personal data with the same care as within the EU and/or the EEA. If there is no adequacy decision by the EU Commission, we ensure careful handling of the personal data with contracts or other appropriate warranties.

Social network data you share with us

We allow you to link our NGEN account to a social network. These social networks may automatically provide us with access to certain personal data they have stored about you (e.g. content you have viewed or enjoyed, information about the advertisements you have been shown or clicked on, etc.). You can determine the personal data that we can access through the privacy settings of each social network. We may also use plug-ins or other technologies from various social networks. If you click on a link displayed through a social network plug-in, you voluntarily connect to that social network.

Data protection during job applications and the application process

The controller collects and processes the personal data of applicants for the purpose of handling the application procedure. The processing may also take place electronically. This is particularly the case if an applicant submits relevant application documents to the controller by e-mail or via a web form located on the website. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG).
